Basil: We're not speaking about a hypothetical, at least as far as I know.
He was charged with assault and battery, and I'm assuming that there are
particular sentencing guidelines for that.  

 

As I also stated fairly clearly, although this isn't an abstract discussion
about incarceration and whether that's an appropriate institution for human
beings, recidivism ought to be a legitimate concern.  I think that's a
pretty conservative remark, really.  You don't even have to acknowledge
sympathy for the "perp" if you don't like to, but it seems that if one is
concerned with further crimes against property or persons - being blinded
for life, if you like - then rehabilitation and opportunities for convicted
criminals ought to be considered.

 

Neither I, nor Paul so far as I know, said that we fundamentally disagree
with the judicial system punishing people for crimes.  In my opinion though,
it seems rather self-righteous to think that super heroes have saved the day
simply by taking him off the street.

So when James took a swing at the bicycle owner, what if those bolt cutters
took the bicycle owner's eyes out and he was blinded for life.  So he may
not have lost his bike but he may have been seriously injured or worse.
Would we still feel the same apathy for James?    It's good to always think
of the other guy and his circumstances but how far does one take this?

Although I won't speak for Paul Centro, it seemed like his proposal was
pretty straightforward, nothing to do with taking him into his home.  He
simply asked, how good should we feel when a possibly "repeat offender" is
taken off the street (for a period of time) without any avenues toward
rehabilitation.  Even without supposing that it was for a drug habit, there
are little to no opportunities or training for job training.  As Paul
mentioned, the person is going to face serious CORI problems with employers
(and this would be true even if he was acquitted), though that issue has
been gaining greater attention recently.

 

Maybe you can make an argument that certain criminals or types of crimes
ought to be removed from the street but even if that's the case, it seems
like a pyrrhic victory if recidivism receives no attention.

I know this is not the answer anyone wants to hear, but that's why we have
judges, who hopefully serve as judicious carriers of what's best for the
individual and what's best for society. 

There are plenty of hard luck cases out there, but like asking about riding
scooter at a CM event, I'll ask this, would you take this dude into your
home?
